UPDATE: Clayton Faces $25,000 Injury Lawsuit

Illinois resident Yvonne Mays claims she broke her foot after tripping on ice and snow in downtown, a document filed in St. Louis County Circuit Court states.

Yvonne Mays filed a lawsuit after falling in when the company that handles insurance claims against city failed to respond, her attorney said.

A court filing claims Yvonne Mays broke her foot Feb. 7 when she "slipped and fell on ice and snow which had not been cleared from the sidewalk" on the west side of Central Avenue just south of Bonhomme Avenue. The document filed Nov. 7 in St. Louis County Circuit Court further claims the fall resulted from "negligence and carelessness" by the City of Clayton. She is seeking more than $25,000 in the case.

On Wednesday, attorney Thomas Magee of HeplerBroom said the fall happened five or six days after a winter storm.

"It wasn't like it happened the day after or that same day," Magee said. His client, an employee at the , had been walking to the MetroLink when she fell and broke her right foot. She was on her way home to Illinois for a dental appointment, Magee said.

The St. Clair County resident required diagnostic tests, surgery and physical therapy as a result of the injury, and more than $2,000 in future medical costs are anticipated, the court filing states. The function and use of her foot has been "seriously impaired and diminished, and has caused and in the future will continue to cause great mental anguish and pain of mind and body."

Clayton received notification of the injury April 13, the document states.

A plate had to be placed in Mays' foot, Magee said.

Magee submitted a demand and medical bills to St. Louis Area Insurance Trust, which he said handles insurance claims against the city. But he said he did not receive a response, which prompted the suit.

He said he hopes to work with Clayton's attorney to get the case resolved.

Clayton City Attorney Kevin O'Keefe said Tuesday that he was not familiar with the case.

It is the second fall-related lawsuit Clayton has faced this year. In September, Debra Finley after tripping on Forsyth Boulevard.
